Terms of Service & Liability Disclaimer

By accessing this website, requesting service, scheduling work, approving an estimate, or allowing repairs to begin, you ("Client") agree to the following legally binding Terms.

1. Service Authorization

Client authorizes BlackTop Diesel & Tire LLC ("Company") to inspect, diagnose, repair, and test operate the listed vehicle or equipment. Authorization may be provided verbally, electronically, by signature, or by permitting work to begin.

The Company may road-test or operate equipment as necessary to confirm diagnosis, safety, and repair verification.

2. Estimates & Additional Repairs

All estimates are based on visible conditions at time of inspection. Additional defects may be discovered during service.

Client authorizes additional repairs up to 15% of the approved estimate unless otherwise limited in writing. Further authorization will be obtained when reasonably possible.

Diagnostic time, troubleshooting, research, and testing are billable regardless of whether repairs are completed.

3. Mobile Service Conditions

Client must provide safe, lawful, and unobstructed access to the vehicle or equipment. The Company reserves the right to refuse or stop service if conditions are unsafe.

Service call and travel fees apply once a technician is dispatched, regardless of repair outcome.

4. Payment Terms

Payment is due upon completion unless written credit terms exist. Client agrees to pay all authorized charges including diagnostics, labor, parts, travel, shop supplies, and applicable taxes.

Chargebacks, payment reversals, or disputes for authorized services are prohibited except in cases of verified fraud. Client agrees to pay all reasonable collection costs, administrative fees, and legal expenses permitted by law.

5. No Consequential Damage Liability

To the fullest extent permitted by law, the Company shall not be liable for loss of income or revenue, load claims or delivery delays, downtime or rental costs, towing expenses, or secondary or consequential damages.

Company liability is strictly limited to the amount paid for the specific service performed.

6. Mechanical & Electrical Risk Disclaimer

Modern commercial vehicles and equipment contain complex electronic, hydraulic, and mechanical systems. Failures may occur unpredictably.

The Company is not responsible for pre-existing conditions, intermittent or non-verifiable faults, failures unrelated to performed repairs, contaminated fuel or fluids, overheating or neglected maintenance, or prior improper repairs.

7. Warranty Limitations

Labor warranty: 30 days unless otherwise stated in writing. Parts warranty: provided solely by the manufacturer.

Warranty does not cover abuse, misuse, operator error, accidents, unauthorized modifications, or unrelated component failures.

8. Website & Digital Use

All website content, branding, logos, and materials are property of BlackTop Diesel & Tire LLC and may not be reproduced without permission.

Use of this website does not create a service contract until work is authorized.

9. Governing Law

These Terms are governed by the laws of the State of Florida. Any dispute shall be resolved in Florida jurisdiction.

10. Agreement Acceptance

Requesting service, approving estimates, or allowing work to proceed constitutes full acceptance of these Terms and Conditions.
